Townies could clear themselves through death note. They have no reason to lie about their role.
I think it's fine the way it is, though allowing vigis and jailors to use a death note wouldn't be as game breaking as some people make it out to be. They'd still have to kill someone to prove they're clear and in most cases you have only limited info to act upon. If you just randomly shoot someone to clear yourself, chances are you still kill someone who's useful to the town. That's not such a fantastic trade-off.
That said, in the right situations it'd be quite powerful. And technically the mafia can currently 'abuse' the system in the same way to ally with the witch if it gives them a majority. Of course it's a lot more rare that townies or neutrals will pretend to be mafia to confuse a witch, because if the mafia has 2 or more players left it'll take some pretty good coordination and luck that the roles you claim to have check out with everything you've said previously in the game.
