Even if he had claimed MARSHALL on the stand, as soon as he was pardoned there wasn't enough time in the day for him to do anything with a reveal, and the Mafia almost certainly would've iced him out that night as there was no role to protect him and he'd received no armor. Even with another townie votes would've likely stonewalled at about the same point.
