So the ending was actually arson vs BD vs enforcer, but I digress...
BD and enforcer voted arson out... Now... since BD can kill if he swaps himself with enforcer, shouldn't this win go to town?

Nope. Triad/Maf wins all ties regardless.
The only way this could be a win is if you're in a save where it goes to night afterwards and the Enforcer is stupid enough to try and attack the Bus Driver.
You can honestly say the same thing about the game ending with a Mayor/Triad left. Mayor had enough votes to kill him, but because They win all ties, it's considered Triad's game.

"Majority" is gained during the day, not the night phase. Which is why triad win. + what AIVION said
